Life Care Plan Rebuttal and Critique Process

Reviewed by KW Life Care Planning Editorial Team

Engagement process

  1. Engagement and materials collection: We confirm scope and conflicts, establish the retainer, and gather the opposing plan, its cost tables and sources, the planner's file when produced, and the complete medical record.
  2. Foundation review: We trace each recommendation in the opposing plan to the medical record and treating provider recommendations, flagging items that lack documented clinical support.
  3. Duplication, frequency, and duration analysis: We identify overlapping or duplicated items and test whether the stated frequency and duration of each item are supported by the record and accepted planning practice.
  4. Pricing and life expectancy review: We examine the pricing sources, geographic basis, and replacement cycles used, and evaluate the life expectancy assumption that drives the plan's total.
  5. Written critique and alternative plan: We deliver a written critique organized by finding and, when requested, an alternative plan that reflects the care the record supports.
  6. Testimony: We provide deposition and trial testimony on the critique and any alternative plan.
